Houston, Texas — The McClees Law Firm, PLLC, announced today that prosecutors have dismissed a murder charge after a detailed and evidence-driven investigation established that the accused acted in lawful self-defense.
The case involved an older Houston-area resident who was confronted by a known violent offender under the influence of narcotics. The encounter escalated rapidly, and the accused fired only after being faced with a clear and immediate threat of deadly force.
The dismissal followed months of extensive investigation and preparation by attorney Ed McClees and his team, who conducted a thorough review of forensic evidence, witness statements, and law enforcement reports. That work revealed facts consistent with Texas self-defense law and demonstrated that the accused had acted responsibly to protect himself and his spouse.
McClees's investigation revelaed that the aggressor had a history of violence and drug activity. He was armed with a handgun at the time of the incident and made repeated threats moments before the shooting occurred. Toxicology testing later confirmed the presence of cocaine, and additional narcotics were recovered from his person during an autopsy.
“Texas law recognizes the right of every citizen to defend themselves and their loved ones when confronted with a deadly threat,” said Ed McClees. “Our firm is grateful that the evidence was evaluated fairly and that justice was ultimately served.”
The dismissal brings a close to a case that underscores the importance of diligent investigation, evidence-based advocacy, and the protection of fundamental rights under Texas law.
