What to do if a loved one is arrested in Harris County?

Few things are more stressful than getting a call saying that a family member has been arrested. In that moment, you may feel panicked, confused, or unsure of what to do next. Understanding the process can help you stay calm, protect your loved one's rights, and take the right steps immediately.

This guide explains what happens after an arrest in Texas—specifically Harris County—and what you should do to help your loved one as quickly and safely as possible.


1. Stay Calm and Gather Information

Your first step is simple: get the basic facts.

Ask (or find out):

  • Where they are being held

  • What they were arrested for

  • Whether they have been booked yet

  • Their full legal name and date of birth

If the person calls you directly, do NOT ask for details about the incident on a recorded jail phone line. Every call is recorded, and prosecutors will use those statements against them.

Instead, say: “Don't discuss the case on the phone. I'm going to work on getting you help.”


2. Confirm Where They Are Being Held

In the Houston area, people are typically taken to:

  • Harris County Jail (Processing takes place at 701 North San Jacinto, which is also known as the Joint Processing Center, or "JPC.")

  • A city jail, such as Houston City Jail

  • A jail in a surrounding county (Fort Bend, Montgomery, Galveston, etc.)

You can search online through the Harris County Inmate Search or call the facility directly.

Until booking is complete, the person may not appear online yet—this is normal.


3. Understand the Booking Process

Booking can take several hours. During this process, officers will:

  • Take fingerprints

  • Take a mugshot

  • Run background checks

  • Inventory personal items

  • Enter charges

  • Hold the person until a magistrate sets bond

The person may be held in a holding tank during this time and will have limited access to phones.


4. Bond: How They Get Out of Jail

In most cases, a bond will be set within 24 hours at a probable cause hearing, also called “magistration.”

There are three main types of bonds in Texas:

  1. Surety Bond – You pay a bondsman (usually 10–15% of the bond amount).

  2. Cash Bond – You pay the full amount to the court; it may be refunded later.

  3. Personal Recognizance (PR) Bond – No money required; the judge releases the person based on conditions.

Important:
Hiring a lawyer early can affect bond conditions and can sometimes affect bond amount.


5. Contact a Criminal Defense Lawyer Immediately

This is the most important step.

A lawyer can:

  • Get detailed information that may not yet be available to the public

  • Contact the prosecutor 

  • Request a lower bond or a PR bond

  • Make sure your loved one does not make harmful statements

  • Begin building a defense before the State gets prepared

  • Limit or prevent harsh bond conditions when appropriate

Early action often means a better outcome.


6. Protect Your Loved One's Rights

Remind your loved one NOT to:

  • Give a statement

  • Talk about the case with other inmates

  • Discuss the case on jail phones

  • Try to explain themselves to police

The only thing they need to say is:
“I want a lawyer.”


7. Start Gathering Helpful Information

To assist the attorney, start assembling:

  • The arrest location

  • The arresting agency

  • Any witness names

  • Text messages, photos, videos, or communications relevant to the incident

  • Medical records (if injuries are involved)

Do not post anything about the incident on social media, and only share this information with the lawyer.


8. Attend the First Court Date

Once released, your loved one will be given a court date. Missing this can result in:

  • A warrant

  • Bond revocation

  • Additional charges

The lawyer will explain what to expect, how to dress, and what to say (and not say) in court.


9. Understand What Happens Next in a Criminal Case

After release, the case moves into one of two tracks:

Misdemeanor Cases

Handled in County Criminal Courts.
Often involve:

  • DWI

  • Assault 

  • Theft

  • Drug possession (small amounts)

Felony Cases

Handled in District Courts.
Include:

  • Aggravated assault

  • Murder

  • Robbery/burglary

  • Weapons charges

  • Sexaul Assault

  • Drug offenses

  • Other serious violent crimes

  • Financial crimes

Felony investigations and court processes are more complex and take longer than most misdemeanor cases.


10. Stay in Communication With the Attorney

A strong defense is a team effort.

The attorney may need:

  • Contact information for your loved one

  • A detailed timeline of events

  • Preliminary documents (photos, receipts, messages)

  • Names of potential witnesses

Encourage your loved one to remain compliant with bond conditions—no new arrests, no missed court dates, no violations.
